General Terms and Conditions (GTC) – EVER Shop
As of: August 2025
1. Scope of Application
These GTC apply to all orders placed via the EVER Shop operated by EVER Health GmbH (address, commercial register details, and managing directors as specified in the App GTC).
2. Subject Matter of the Contract
We offer health and dietary supplement products via our online shop. Orders may be placed by consumers (Section 13 of the German Civil Code [BGB]) and, where applicable, by business customers (Section 14 BGB).
3. Conclusion of Contract
By submitting an order, you make a binding offer. The contract is concluded upon our dispatch confirmation or the delivery of the goods.
4. Right of Withdrawal & Returns
Consumers have a 30-day right of withdrawal, provided the goods are unopened and in their original packaging (see separate instructions on the right of withdrawal).
5. Prices & Payment
All prices include statutory VAT. Payment methods (e.g., credit card, PayPal, SEPA) are displayed during the ordering process.
6. Delivery
Delivery is made to the specified address. Delivery times are indicated in the shop. Risk passes upon delivery to you or to the person designated by you.
7. Retention of Title
The goods remain our property until full payment has been received.
8. Warranty & Liability
Statutory warranty provisions apply. As with the App GTC, our liability is limited to cases of willful misconduct and gross negligence; statutory exceptions remain unaffected. Liability for simple negligence resulting in a breach of duty is excluded to the extent permitted by law.
9. Amendments to the GTC
We reserve the right to amend these GTC. We will implement changes at a future date and notify you accordingly. You have a 14-day right to object; otherwise, the amended GTC will be deemed accepted—analogous to the provisions in the App GTC. 10. Final Provisions
German law applies, excluding the UN Sales Convention (CISG). To the extent permitted by law, the place of jurisdiction is the registered office of EVER Health GmbH. Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected (severability clause).
